THE GAUHATI HIGH COURT (HIGH COURT OF ASSAM, NAGALAND, MIZORAM AND ARUNACHAL PRADESH)
Saptarshi Das, Deputy Registrar (Bench)
SANKAR DAS AND ANR – Appellant
Versus
THE STATE OF ASSAM AND 4 ORS – Respondent
WP(C)/4874/2025
ORDER
Case taken up before the Lawazima Court.
None appears on behalf of the petitioners.
Perused the records.
Perusal of the instant case record reveals that the petitioners took fresh steps for issuance of notice to the respondent Nos. 4 & 5 through registered post with A/D on 10.09.2025.
However, notices could not be issued due to a shortage of requisite postal stamps and discrepancies in the addresses provided on the submitted envelopes. In view of the above, the previous Lawazima Court, vide its order dated 01.04.2026, directed the petitioners to approach the concerned section within 7 (seven) days to furnish the deficit postal stamps and correct the addresses.
Vide the same order, the concerned section was directed to convey these discrepancies to the petitioners or their learned counsel via phone/email. Consequently, the matter is listed before the Lawazima Court today with an office note dated 02.05.2026, stating that the section communicated these details to the petitioners' counsel on 02.04.2026.
Despite this, the office note states that the learned counsel for the petitioners has not yet approached the section to rectify the postal deficit or the addresses. As such, notice could not be issued to respondent Nos. 4 & 5.
In view of the above, the petitioners are afforded further one week time to approach the concerned section and make the necessary corrections as prescribed by the order dated 01.04.2026.
Let the matter be listed before the Lawazima Court again on 29.05.2026.
