ORDER
Heard Mr. C.T Jamir, learned Sr. counsel assisted by Mr. Aliba Ozukum, learned counsel for the petitioners. Also heard Mr. Moa Imchen, learned Sr. Government Advocate appearing for the respondent No. 1 to 5.
The instant writ petition has been filed by the petitioners aggrieved by the order dated 22.04.2026 passed by Additional Deputy Commissioner, Kohima with regard to the election of the village council of Nerhe-Model Village.
It is contented by the learned Sr. counsel that vide notification dated 13.03.2026, the Deputy Commissioner, Kohima directed all the villages to have fresh election for the village council members and the date of election was fixed on 25.03.2026 and accordingly, the election was held wherein four rounds of voting was held and 4 candidates were selected for the 4 posts of members by raising hands. The petitioners have been selected as the village council members in said process.
Subsequently, based on the complaint made by the Head GB of the village, the Office of the Additional Deputy Commissioner, Kohima without making any inquiry cancelled the election but directed for a fresh election again without cancelling the earlier election and subsequently, there was another election held on 24.04.2026.
The learned Senior counsel for the petitioners submitted that at this stage, while notice may be issued and he is praying for an interim that no any appointment should be made pursuant to the second election held on 24.04.2026 and that the same was held without cancelling the earlier election which was held on 25.03.2026.
Issue notice to the respondents returnable within 3(three) weeks.
Extra copies of the writ petition along with documents may be furnished to the learned Senior Government Advocate during the course of the day. Steps for service of notice may be taken through speed post as well as dasti process may be taken upon the respondent No. 6 to 9 (private respondents) and thereafter compliance affidavit may be filed.
I have given my due consideration for the interim prayer and on perusal of the relevant materials, it is directed that till the next returnable date, the respondent authorities shall not give effect to any appointment vis-a-vis subsequent election held on 24.04.2026.
