The court is addressing a claim for unpaid arrear salary of an Assistant Teacher, where the delay is attributed to the lack of Financial SIU approval, and has issued a notice of motion to the respondents.

ORDER

Heard Mr. M. Khan, learned counsel for the petitioner, who submits that by filing this writ petition, the petitioner claims for payment of arrear salary for the period w.e.f. 01.12.2023 to 29.02.2024 amounting to Rs. 1,07,809/-. The learned counsel submits that the petitioner is working as an Assistant Teacher in Rangpur Bualipar M.E. School and apparently, due to non receipt of Financial SIU approval in due time, the amount has not been paid to the petitioner.

In this connection, the learned counsel has drawn the attention of this Court to the statement showing the required information year-wise prepared in the form of a performa annexed to the writ petition as Page – 23 & 23A.

This Court at several occasions had asked the learned counsel appearing for the respondents to obtain instructions in the matter but since no instructions is forthcoming till date, let the notice of motion be issued, returnable by three (3) weeks.

Mr. P. K. Bora, learned Standing Counsel, Elementary Education Department, Govt. of Assam, accepts notice on behalf of the respondent Nos. 1, 3, 4 & 5 and Mr. P. Nayak, learned Standing Counsel, Finance Department accepts notice on behalf of the respondent Nos. 2 & 6. Notice is therefore complete.

Petitioner to serve requisite extra copies of the writ petition to the learned Standing Counsels appearing for the respondents today, within two (2) working days.
