ORDER

Ms. H. Terangpi, learned counsel for the respondent on instruction has submitted that the arrear salary proposal in respect of the petitioner was received from the Inspector of Schools, SDC, Sribhumi on 27-04-2026 and the same is under process.

As noticed in the order dated 20-04-2026, the petitioner praying for being authorized arrear salary w.e.f. 18-02-2014 to 28-02-2015, had approached this Court by way of instituting a writ petition being W.P.(C) No. 3815/2018. The said writ petition was disposed of by a Coordinate Bench of this Court vide order dated 05-08-2019, directing the respondent authorities to verify the claim of the petitioner for being authorized his arrear salaries for the said period and to release the same to him. It is seen that the petitioner had furnished certified copy of this order to the respondent authority proximate to the time of passing of the said order. However, from the instruction furnished today by Ms. H. Terangpi, learned standing counsel, Secondary Education, it is revealed that the respondent authorities had never processed the matter for compliance. It is only on 27-04-2026, i.e. after passing of the order dated 20-04-2026 in the present proceeding that the matter was processed by the respondents. As there is a requirement for also authorizing to the petitioner an interest @ 7% on the arrear amount, the Director of Secondary Education, Assam shall place before this Court the reason as to why the petitioner’s arrear salary proposal was not processed immediately after passing of the order dated 05-08-2019 in W.P.(C) No. 3815/2018. The Director shall also place on record along with the said report the names of all the persons who were to process the matter after passing of the said order dated 05-08-2019 both in the office of the Inspector of Schools, SDC, Sribhumi as well as in the Directorate of Secondary Education, Assam. The said names are required so as to apportion the interest amount amongst the persons so responsible to process the matter. The said report along with the names of the persons be placed before this Court on 18-05-2026.

No further adjournment shall be granted for the purpose on the next date fixed.
