Heard Mr. T. Laskar, learned counsel appearing for the petitioner. Also heard the

learned APP.

This is an application under Section 482 of the BNSS praying for pre-arrest bail

in connection with Kheroni PS Case No. 54/2025 under Sections 61(2)

(b)/196(1)/197/353(1)(b)/353(1)(c)/353(2)/3(5) of the BNS, 2023 r/w Sections 3(1)

(r)/3(1)(5)/3(1)(4) of the SC/ST (Prevention of Atrocities) Act, 1989.

The learned counsel for the petitioner has submitted that the petitioners are

eager to appear before the Investigating Authority but apprehend arrest.

The learned counsel for the petitioner further submitted that even as per the

FIR, the allegations are only of raising slogans during a protest rally. Accordingly, the

petitioners are directed to appear before the Investigating Officer of the case on or

before 24.04.2026 to participate in the investigation and have their statements

recorded.

The updated Case Diary will be produced before this Court on 29.04.2026, since

the Case Diary has also been called for in AB No. 269/2026, which is fixed on

29.4.2026.

It is provided that in the meantime, if the petitioner is arrested, he shall be

released on bail on executing a bond of Rs. 20,000/- with one surety of the like

amount subject to the following conditions:-

(i) that the petitioner shall fully co-operate with the investigation of the case

and will appear before the Investigating Officer as and when required in connection

with the investigation of the aforesaid P.S. case; and

(ii) that the petitioner shall not, directly or indirectly, make any inducement,

threat or promise to any person acquainted with the facts of the case so as to

dissuade him/her/them from disclosing such facts to the Court or to any police officer.
