ORDER
It is submitted by Mr. U. Sarma, learned Govt. Advocate, Assam appearing for the respondent that the respondent authorities were apprised about the institution of the present writ petition and a copy of the writ petition was also forwarded to the respondent authorities in the year 2025 itself. However, he submits that the respondents have not furnished any instruction to him in the matter.
The said state of affairs as brought on record by the learned counsel for the respondents is really unfortunate. The present matter is pending since 2023 and has been adjourned on several occasions only to facilitate the respondent’s counsel to complete their instruction in the matter. However, till date respondent’s counsel are without any instruction.
The petitioner’s claim, in the present writ petition for being authorized his arrear salary w.e.f. 18-02-2024 to 28-02-2025, was already examined by this Court in W.P.(C) No. 3851/2018 and vide order dated 05-08-2019, a direction was issued to the respondent authorities to verify the claim of the petitioner for payment of the arrear salaries for the said period and to release the same to him. It was also provided that if the petitioner is similarly situated as the petitioner in W.P.(C) No. 5085/2016, who had similar grievance, then he shall also be extended to be granted interest @ 7% on the due amount after making necessary verification. The petitioner has, thereafter, approached the respondent authorities on number of occasions and it is also seen that the Headmistress of the school where the petitioner was serving has also submitted proposal for drawl of the arrear salaries of the petitioner. However, it is seen that the respondent authorities have not acted in the matter.
Mr. U. Sarma submits that he be granted a week’s time, by which time be shall apprise this Court as to the date by which the petitioner shall be released his arrear salaries as directed by this Court and noticed, hereinabove.
Registry to list this matter again on 28-04-2026 for further hearing.
