THE GAUHATI HIGH COURT (HIGH COURT OF ASSAM, NAGALAND, MIZORAM AND ARUNACHAL PRADESH)
Anjan Moni Kalita, J
PURBANCHAL BUILDTECH PVT. LTD AND ANR – Appellant
Versus
THE STATE OF ASSAM AND ORS – Respondent
WP(C)/2720/2026
For the Appellants/Petitioners: A Borua, T J Mahanta
For the Respondents: B Choudhury
The court may grant interim relief in tender disputes if prima facie evidence suggests that a technical bid was arbitrarily rejected despite compliance with digital signature requirements.
Headnote:The petitioner challenged the rejection of their technical bid for a PWD project involving road improvement and up-gradation under Asom Mala 3.0, based on Clause 26(1)(b) of the Instructions to Bidder regarding digital signatures. The petitioner provided a screenshot as evidence that the documents were digitally signed on 01.02.2025, contending that the rejection was arbitrary. The primary issue was whether the rejection of the technical bid was justified given the evidence of digital signing. The court observed that based on the documents referred to by the petitioner, there was a prima facie case suggesting the rejection was uncalled for. Therefore, it is directed that the respondent authorities, till 01.06.2026, will not issue any work order (if not issued yet) in connection with the aforesaid NIT dated 20.01.2026.
