ORDER
Mr. Gadhia, learned Counsel for the petitioner has submitted that at the first instance, the reference came to be decided ex-parte and therefore, the petitioner has approached the concerned Court and prayed to hear the matter by-parte. He has further submitted that the said request was not considered by the concerned Court and the petitioner has approached this Court.
Learned Counsel for the petitioner has further submitted that in the meantime, the concerned respondent workman approached the authority for withdrawal of his gratuity amount, which was withdrawn by the respondent workman. He has further submitted that even the petitioner has offered reasonable amount of compensation to the respondent workman and on many workman to join the duty however, respondent did not give any response to the same, instead of that, the respondent workman has filed recovery applications before the concerned authority.
Today, Mr. Gadhia, learned Counsel for the petitioner has submitted under instruction that the petitioner is ready and willing to pay Rs.10,00,000/- to the respondent workman as lumpsum compensation for full and final settlement.
