1.Present application under section 24 of the Code of Civil Procedure, 1908 (for short “the Code”) is filed by the by the applicant – wife to transfer Family Suit No.221 of 2023 pending with the learned Family Court, Nadiad to the Family Court, Vadodara.

2.It is the case of the applicant that she resides at Vadodara and got married with the opponent on 17.02.2017 as per Hindu rites and rituals, whereas the respondent – opponent has preferred the aforestated Family Suit in the Court at Nadiad only with a view to harass the applicant mentally as well as physically. It is submitted at bar that it will not be possible for the applicant to travel along with her baby boy, namely Krutarth, aged about 3 years and it would be physical and mental harassment to both to travel on each adjournment from Vadodara to Nadiad. The applicant has filed application for domestic violence against the opponent herein before the Chief Judicial Magistrate Court, Vadodara bearing Criminal Misc. Application No.2877 of 2024 and the same is pending before the CJM Court at Vadodara.
