ORAL JUDGMENT
1. By way of present Revision Applications under section 397 read with section 401 of Cr.P.C., the petitioner - original accused has prayed to quash and set aside the judgment dated 23.11.2000 passed by the learned Chief Judicial Magistrate, Navsari in Criminal Case No.7411 of 1994, whereby, learned Trial Court has convicted the petitioner for the offence under section 409 of IPC and sentence to under go 5 years simple imprisonment and to pay fine of Rs.2000/-, in default of payment, further SI for two months and convicted the petitioner for the offence under section 477A of IPC and sentence to undergo SI for one year. Learned Trial Court also ordered that the sentence shall run concurrently. The said judgment is confirmed by the learned Sessions Judge, Navsari in Criminal Appeal No.9 of 2001 vide order dated 14.08.2002. Hence, present Revision Application.
2. Facts of the case are as under :-
2.1. The petitioner was serving as Branch Post Master in Sarbhon Paradi Branch Post Office. On 18.01.1994, Sub Divisional Inspector of Indian Post Office Chikhali visited the Sarbhon Pardi Branch Post Office for inspection and during inspection he received 17 saving bank pass book
