ORAL ORDER
1. RULE. Learned APP waives service of rule for the respondent-State.
2. The present application is filed under Section 439 of the Code of Criminal Procedure, 1973, for regular bail in connection with FIR being C.R.NO. 11213042240185 of 2024 registered with Paddhari Police Station, Rajkot.
3. Learned Advocate appearing on behalf of the applicant submits that considering the nature of the offence, the applicant may be enlarged on regular bail by imposing suitable conditions. 4. Learned APP appearing on behalf of the respondent-State has opposed grant of regular bail looking to the nature and gravity of the offence. He has submitted that the offence in question had been committed in presence of the present applicant by the other co-accused. He, therefore, submitted to dismiss the present application.
5. I have heard the learned advocates appearing on behalf of the respective parties and perused the papers. The present applicant is a lady, who has been arraigned as an accused in in the present offence, as allegedly the entire incident had taken place in her presence. Except this, no other overt act has been attributed to the present applicant.
