ORAL ORDER
[1.0] Since both these petitions are filed by separate petitioners – accused seeking quashing of one common FIR, both these petitions are heard, decided and disposed of by this common oral order.
[2.0] By way of present petitions under Section 482 of the Code of Criminal Procedure, 1973 (for short “CrPC”), respective petitioners are seeking quashing of FIR being CR No.I-23 of 2011 registered with DCB Police Station, Vadodara City for the offence punishable under Sections 465, 467, 468 , 471 and 114 of the Indian Penal Code, 1860 (for short “ IPC ”) alongwith all its consequential proceedings. Accused Nos.2 to 5 have filed Criminal Misc. Application No.8103/2012 and accused No.1 has filed Criminal Misc. Application No.6251/2012. For the sake of brevity, Criminal Misc. Application No.8103 of 2012 is taken as a lead matter and facts of the said petition are considered.
[3.0] The impugned FIR is filed at the instance of respondent No.2 alleging therein that the land bearing Revenue Survey Nos.393, 394 and 390 situated at Gotri, Vadodara originally belonged to Shri Ravjibhai Brahmbhatt and after his demise, the land was transferred to his legal heir viz.
