ORAL JUDGMENT

1. Present petition is filed under Articles 226 and 227 of the Constitution of India by the petitioner – workman seeking for quashing and setting aside the impugned award dated 25.11.2019 passed by the learned Senior Civil Judge, Labour Court No.2, Rajkot in Reference (L.C.R.) No. 173 of 2015 whereby the Labour Court has rejected the reference filed by the petitioner.

2. Facts of the present petition are that the respondent – Corporation issued public advertisement in the local newspaper and on the basis of the advertisement, the petitioner has applied for the post of pump operator in the category of SCBC and after verifying the documents, he was appointed as a pump operator along with the others in the water works department with the respondent – Corporation. It is the case of the petitioner that an inquiry was held and the selection committee held that one Mr.Pradip Hathisinh Tuvara who appointed in the SCST category, was not actually SCST candidate but he was an SEBC candidate and therefore the merit list was revised and Mr.Tuvara was placed in SEBC list.
