CAV ORDER
(PER : HONOURABLE MR. JUSTICE BIREN VAISHNAV)
1. The question in these applications that bothers us is whether the order passed by the Apex Court in Misc. Civil Application No. 21 of 2022 in Re: Cognizance for Extension of Limitation reported in (2020) 19 SCC 10 dated 23.03.2020 and its subsequent orders dated 06.05.2020, 10.07.2020, 08.03.2021, 27.04.2021 and 23.09.2021 made in the same proceedings will give a litigant the benefit of extending the limitation and consequently extend the period upto which the delay can be condoned, if the limitation for filing an appeal has already expired much before the relevant data i.e. 15.03.2020.
1.1 To put it differently, if the prescribed period of limitation in filing an appeal had already expired before 15.03.2020, can a litigant who files an appeal post the period of 15.03.2020 to 28.02.2022 be given a set off of the period of orders in Re: Cognizance For Extension Of Limitation in counting the number of days in condoning delay in filing such app
