ORDER

1. This is an application by the applicant under Section 438 of the Code of Criminal Procedure , 1973 for anticipatory bail in the event of her arrest in connection with FIR registered at C.R.No.11821030220351 of 2022 before Jhalod Police Station, Dahod for the offence under Sections 5(1), 6A(2)(a), 8(2), 8(4), 10, etc. of the Gujarat Animal Preservation (Amendment) Act, 2017 and Sections 429 and 114 of the Indian Penal Code .

2. Learned advocate appearing on behalf of the applicant would submit that the applicant is innocent and falsely implicated in the alleged offence. He submitted that the sample were collected and sent to FSL Surat on 04.08.2022, i.e. after three days of the incident which create serious suspicious on the case of prosecution. He further submitted that the applicant is a lady accused and a senior citizen aged about 63 years and not having any criminal antecedents. He, therefore, submitted that considering the nature of offence, the applicant may be enlarged on anticipatory bail by imposing suitable conditions.
