ORDER
RULE. Learned APP waives service of notice of rule on behalf of the respondent State.
1. This application has been filed under section 439 of the Code of Criminal Procedure for regular bail in connection with the complaint being FIR No.11206079220289 registered with Ladol Police Station, District : Mehsana for offences punishable under sections 363, 366, 376(2)(N) and 376(3) of IPC read with sections 4, 5(L), 6, 8 and 12 of POCSO Act.
2. Learned advocate Mr. Zaveri for the applicant submitted that investigation is over and charge-sheet is also filed. The applicant was aged about 21 years and the victim was aged about 16 years at the time of alleged incident. There was love relationship between the two and the victim has left with the company of the applicant at her own free will and volition.
Their relation was consensual in nature. It was, therefore, prayed that the present application may be allowed and the applicant herein may be released on regular bail.
3. Learned APP submitted that the offence alleged against the applicant is serious in nature and that if released on bail, he would flee justice and would not be available for trial. It was, therefore, prayed that no d
