ORDER

1. Rule returnable forthwith. Mr. Soaham Joshi, learned AGP waives service of notice of rule on behalf of respondent State.

2. Fixation of pension on the basis of not counting service of the petitioner from the initial date of appointment despite specific directions from this court in the order dated 07.04.2016 passed in Special Civil Application No. 16114 of 2013 in case of the petitioner has resulted in filing the present petition. The present petition is challenging the order dated 18.10.2008 passed by the respondent no. 4.

3. Earlier the present petitioner had filed the aforesaid petition being Special Civil Application No. 16114 of 2013, prayer of which reads as under:

“(17)(A) to issue writ or writs in the nature of mandamus and/or any other writ or orders or directions.

(B) to quash and set aside order dtd.18/10/2008 Annexure B passed by respondent No.1 to the extent of not granting pension and gratuity on the basis of 29 years.

(C) to hold that resolution dtd. 24/3/2006, Annexure-E passed by the Road & Building Department excluding the tenure prior to regularization from entire tenure for the purpose of computi
