ORAL ORDER

1. Heard learned Advocate Mr. Jarjeeskhan on behalf of the applicants and learned APP Ms. M. D. Mehta for the respondent-State, learned Advocate Mr. P. V. Patadiya on behalf of the respondent no. 2.

2. By way of this application, the applicants pray for quashing of FIR being C. R. No. II- 27 of 2017 registered with the Vijalpor Police Station, Dist. Navsari on 07.05.2017 for offences punishable under Sections- 498A, 323, 504, 506(2), and 114 of the Indian Penal Code and Sections-

3 & 4 of Dowery Pohibition Act.

3. Learned Advocate Mr. Jarjeeskhan would submit that while originally the petition had been preferred challenging the impugned FIR on its merits, pursuant to filing of this petition, the applicants and the complainant have settled the matter inter se and whereas learned Advocate Mr. Khan would submit that both the parties have also submitted an application before the Learned Family Court, Navsari for divorce. Learned Advocate Mr. Khan would therefore submit that impugned FIR may be quashed by this Court, more particularly, based on the settlement.
