ORAL ORDER

Learned advocate for the appellants does not press this appeal and seeks permission to withdraw present appeal qua appellant No.1 – Akshay Jayeshbhai Patel.

Permission, as prayed for, is granted. Present appeal is disposed of as not pressed qua appellant No.1 – Akshay Jayeshbhai Patel.

[1] The present appeal is filed under Section 14(A) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocity) Act, by the appellant No.2 for regular bail in connection with an FIR being C.R.No. I-257 of 2019 registered with Athwalines Police Station, District: Surat for the offences under Sections 307, 302, 120(B), 201 and 114 of the Indian Penal Code and under Sections 3(1)(r), 3(2)(5), 3(2) and 5(A) of the Atrocity Act and under Section 135(1) of the Gujarat Police Act.

[2] Learned advocate for the appellant No.2 submits that considering the nature of allegations, role attributed to the appellant No.2, the appellant No.2 may be enlarged on regular bail by imposing suitable conditions.

[3] Learned Additional Public Prosecutor appearing on behalf of the respondent-State has opposed grant of regular bail looking to the nature and gravity of the offence.
