1 The appellant has filed this appeal under Clause 5 of the Letters Patent challenging the order dated 15.02.2019 passed by the learned Single Judge in Special Civil Application No.3016 of 2019.
2 Having heard learned counsel for the appellant, considering the facts and circumstances of the case and on perusal of the record of the case, including the impugned order, it appears that the petitioner filed the petition invoking jurisdiction under Articles 226 and 227 of the Constitution of India challenging the order dated 02.02.2019 passed by the Debt Recovery Tribunal-I at Ahmedabad in I.A.No.203/2019 though the petitioner has alternative remedy before the Debt Recovery Appellate Tribunal under Section 18 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The learned Single Judge has rightly dismissed the petition filed by the petitioner vide order dated 15.02.2019, which reads as under:
“1. The petitioner by way of present petition has challenged the order dated 02.02.2019 passed by the Debt Recovery Tribunal at Ahmedabad (hereinafter referred to as ‘the DRT’)
