ORAL JUDGMENT

The applicant has preferred this Revision Application under Section 397 read with Section 41 of the Code of Criminal Procedure to challenge the order dated 10.4.2014 passed by the learned Judicial Magistrate, First Class, Petlad in case no. 205 of 2007 as confirmed by the Sessions Court, Anand vide order dated 21.1.2015 passed in Criminal Appeal No. 44 of 2014 whereby the applicant- appellant is convicted under Section 138 of the Negotiable Instruments Act and directed him to undergo simple imprisonment of six months and to pay a fine of Rs. 2 lacs as compensation to the respondent no.2 complainant.

2. During the pendency of this Revision Application, the applicant has deposited the amount of disputed cheque in the trial court in five instalments of Rs. 40,000/- each. Learned advocate Mr. Amir for respondent no.2 confirms on the basis of the receipts of deposits shown to him by the learned advocate Mr. Quereshi for the applicant that the amount of disputed cheque is deposited in the trial court.

3. Learned advocate Mr.Quereshi has produced the receipt of the deposit of Rs. 2 lacs in the trial court which receipts are taken on record.
