ORAL JUDGMENT
[1] The present acquittal Appeal has been filed by the appellant – original complainant, State of Gujarat under Section 378 of the Cr. P.C., against the Judgment and order dated 30.09.2011 rendered by the learned Special Judge (A.C.B.), Court No.18, City Sessions Court, Ahmedabad, in Special Case No.14 of 2006. The said case was registered against the present respondent original accused for the offence under Sections 7, 13(1)(d)(i)(ii)(iii) and 13(2) of the Prevention of Corruption Act.
[2] According to the prosecution case, complainant Manishbhai Natwarlal Choksi had jewellary shop and had kept two wight measurement machines at his shop. Checking and verification certificate was obtained from the Weight and Measures Department and stamping was also made on the machine, which has to be done on 30th June every year. The complainant went to the office of respondent-accused on 26.06.2005 and met Mr.H.L.Desai. Mr. Desai told him that he was busy with some official work and he will personally come and consider the work of stamping of weighing.
