JUDGEMENT

(PER : HONOURABLE MR.JUSTICE KS JHAVERI)

1. Challenge in these Letters Patent Appeals preferred under Clause­15 of the Letters Patent is to the common order passed by the learned Single Judge in Special Civil Application No.8161/2010 & allied matters dated 30.08.2010 whereby, the said group of petitions were dismissed.

2. Before the learned Single Judge, the legality and validity of the judgment and award passed by the Labour Court, Valsad in Reference (LCV) No.734/1999 dated 19.11.2009 was under challenge. By the said award, the appellant­Company, original petitioner, was directed to reinstate the workmen, in all 103, in service on their original post with continuity of service and 50% back wages. The said award was confirmed by the learned Single Judge by passing the impugned order.

3. Today, when the matters were taken up for hearing, learned counsel Mr. Asim Pandya presented written submissions on behalf of the appellant though his name is not on record.
