IN THE HIGH COURT OF GUJARAT AT AHMEDABAD
ILESH J. VORA, P. M. RAVAL, JJ
RANABHAI BAGHABHAI BHAMMAR – Appellant
Versus
POLICE COMMISSIONER – Respondent
R/SPECIAL CRIMINAL APPLICATION NO. 6533 of 2025
For the Appellants/Petitioners: MR KEVAL G BRAHMBHATT
For the Respondents: MS KRINA CALLA APP
The distinction between 'law and order' and 'public order' is crucial; mere disturbances of law and order do not justify preventive detention under the relevant Acts.
Headnote:The petitioner challenged the detention order under the Gujarat Prevention of Anti-social Activities Act, 1985, alleging that the grounds for his detention did not relate to public order. The respondent contended that the petitioner was a habitual offender whose actions affected the community. The court found the evidence insufficient to substantiate a threat to public order as defined under the Act. The court highlighted the necessity of differentiating between law and order disturbances versus those that impact public order. The detention order was quashed and the petitioner was ordered to be released.
