STATE OF GUJARAT – Respondent
R/SPECIAL CRIMINAL APPLICATION (QUASHING) NO. 2888 of 2019
For the Appellants/Petitioners: MR A A ZABUAWALA
For the Respondents: NIYANT R BHIMANI, MR TIRTHRAJ PANDYA
The power under section 319 of the CrPC to summon additional accused must be exercised prudently and based on strong evidence.
Headnote:The petitioner sought to quash an order of the trial Court under section 319 of the CrPC, which summoned him as an additional accused in a vehicular homicide case. The trial Court's conclusions were deemed poorly reasoned as they improperly rectified or replaced the accused rather than adding. The Court highlighted the discretionary power under section 319, emphasizing it should be exercised sparingly.
Result: The impugned order was quashed, and the trial Court was instructed to expedite proceedings against the originally identified accused.
