2. We have heard Mr.N.J. Shah, learned advocate and Mr.Aditya Jadeja, learned APP for respective parties.
4. The present appeal and the application for suspension of sentence arise from the judgment dated 31.08.2023 and order of sentence passed in Sessions Case No. 382 of 2018, whereby, the applicant herein was convicted and sentenced as under:

Facts and circumstances giving rise to file present application are that the applicant accused was having suspicion that the deceased Rajnikant alleged to have stolen his money, as a result of which, on 17.04.2018, he stabbed the deceased with the knife on the vital part of the chest which was fatal to the deceased.
