ORAL ORDER
1. By way of this application under Section 482 of the Code of Criminal Procedure, 1973 , the applicant has prayed to quash and set aside the Criminal Complaint being C.R. No. II-3346/2013 for the offences under Section s 323 , 294(A), 506(2) read with Section 114 of the Indian Penal Code, 1860 (for short, the IPC ) and all the consequential proceedings arising therefrom.
2. Learned advocate Mr. N.V. Gandhi for the petitioners mainly contended that prior to the filing of the impugned FIR, petitioner No.1 had instituted Civil Suit No.313 of 2013 before the City Civil and Sessions Court, Ahmedabad. He further submitted that the Civil Court had granted interim injunction in favour of the petitioner. However, with an intent to pressurize the petitioner into a settlement, the respondent has lodged a false FIR.
