ORAL ORDER
1. The office report indicates that the notice upon the respondent has been served through the Regd. Post A.D. The returnable date shown in the notice was 16.05.2025. On various dates fixed thereafter, no on has put in appearance.
2. The respondent, thus, has not put in appearance in the present proceedings inspite of due service of notice.
3. The arbitration clause in the agreement in question reads as under :-
"13. DISPUTE RESOLUTION Any dispute or claim arising out of or in connection herewith, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the provisions of the Indian Arbitration & Concillation Act, 1996 as amended from time to time.
The arbitration tribunal shall be composed of a sole arbitrator appointed with the mutual consent of the parties. The place of arbitration shall be Vadodara, Gujarat, India and the arbitration proceedings shall take place in the English language. The award of the arbitrator shall be final and binding on the parties."
4. The notice under Section 21 of the Arbitration and Conciliation Act, 1996, served upon the respondent is appended at page '50' of the paper book.
