1. Rule. Learned APP waives service of notice of Rule on behalf of respondent State.
2. The present application is preferred by the applicant – original accused under Section 430 of the Bhartiya Nagarik Suraksha Sanhita 2023 for suspension of sentence awarded to him vide judgment and order of conviction and sentence dated 24.7.2025 by the learned 4th Additional Sessions Judge, Mehsana in Sessions Case No.2 of 2023.
3. Learned advocate Mr.Yogendra Thakore appearing for the applicant would submit that :
(a) That the applicant has got very strong prima facie case of acquittal.
(b) That the applicant accused has been convicted for a period of 5 years rigorous imprisonment under section 304(II) of IPC and the applicant has undergone 2 years, 10 months and
