1. Rule. Learned APP waives service of notice of Rule on behalf of respondent State.
2. The present application is preferred by the applicant – original accused under Section 430 of the Bhartiya Nagarik Suraksha Sanhita 2023 for suspension of sentence awarded to him vide judgment and order of conviction and sentence dated 2.5.2025 by the learned 5th Additional Sessions Judge, Ahmedabad (Rural) in Sessions Case No.44 of 2022.

Learned advocate Mr.J.V.Patel appearing for the applicant has mainly contended that the applicant has been convicted for the offence under section 323 of IPC and he has been ordered to undergo simple imprisonment for six months and to pay fine of Rs.2000/-, in default, to undergo simple imprisonment for two months.
