Employers must adhere to statutory requirements for employee notification and compensation upon closure, as per the Industrial Disputes Act.

Headnote:(A) Industrial Disputes Act, 1947 - Sections 25F, 25FFA, and 25FFF - Closure of hotel and claim for reinstatement by workmen - Closure not properly notified or compensated as per mandates of the Act - Claims upheld by Labour Court but contested without proper representation from employer - Determined that ex gratia payment and outstanding dues are due to workmen. (Paras 9, 10, 11, 12)

(B) Employment Law - Equity and Rights of Workmen - Long delay in claims processing and equitable right established in favor of workmen for outstanding payments - Workers entitled to compensation and notice pay as specified in the Act. (Paras 8, 9)

Facts of the case:
The appellant operated a hotel which has been closed since December 1996 without following due procedure for notice or retrenchment compensation, leading to multiple claims from workmen. The Labour Court ruled in favor of the workmen, but the appellant contested claims regarding personal liability.

Findings of Court:
Each workman is entitled to various dues calculated from December 1996 until the deemed closure date, along with statutory retrenchment compensation and additional clauses for outstanding payments.

Issues: The main issue centers on the determination of precisely when the hotel closed and corresponding worker entitlements.

Ratio Decidendi: The court emphasized that statutory compliance under the Industrial Disputes Act is mandatory, particularly concerning notifications of closure and employee entitlements under the law.

Result: Appeals partly allowed, previous orders modified; clear directives for payments issued.
