ORAL JUDGMENT

1. In these petitions overlapping issues arise. They have, therefore, been heard together and are being disposed of by this common judgment.

2. Petitioner of Special Civil Application No.1870 of 2006 one Shri Pravinbhai Harivallabhai Dubey has challenged the validity of bye-laws Nos.13.1(i), 15.1 and 18.1(i) of respondent No.3 Gujarat State Cooperative Milk Marketing Federation Limited (hereinafter to be referred to as "the said Federation"). Direction is also sought against respondent No.3 to amend its bye-laws so as to bring the same in conformity with the statutory provisions and the scheme of the Gujarat Cooperative Societies Act 1961 (hereinafter to be referred to as "the said Act") and the Gujarat Specified Cooperative Societies Elections to Committees Rules, 1982 (hereinafter to be referred to as "the Rules of 1982"). The petitioner has also challenged the Government notification dated 4.7.1973 issued by the State Government in exercise of powers under section 161 of the said Act by which the State Government has granted exemption to the Federal Societies of District Milk Producers Unions form the provisions of sub-section (1)of section 28 of the said Act.
