JUDGEMENT
1.00. As common question of law and facts arise in both these Criminal Revision Applications and are between the same parties, both these Criminal Revision Applications are heard, decided and disposed of by this common Judgement and Order.
2.00. Criminal Revision Application No. 344 of 2012 has been preferred by the petitioner – original accused to quash and set aside the impugned Judgement and Order of conviction and sentence passed by the learned Additional Chief Judicial Magistrate, Jamnagar in Criminal Case No. 57 of 2010 dtd.26/12/2011 convicting the petitioner - original accused for the offence punishable under section 138 of the Negotiable Instruments Act for dishonour of the cheque No.293015 for an amount of Rs.50,000/- which was issued by the petitioner - original accused towards the part payment as well as the impugned Judgement and Order passed by the learned appellate court - learned 2nd Additional Sessions Judge, Jamnagar in Criminal Appeal No.1 of 2012 dtd.30/6/2012 by which the learned appellate court has dismissed the said appeal preferred by the petitioner - original accused confirming the Judgement and Order of conviction and sentence passed
