IA ORDER

1. Heard learned advocate for the applicant who has submitted that, the applicant is a businessman who is supposed to travel abroad for expansion of his business. The co-ordinate bench vide order passed in Criminal Misc. Application No. 13346 of 2020 on 18.09.2020 had granted bail to the applicant subject to the conditions, wherein, one of the conditions 9(f) was pertaining to depositing his passport before the trial court and not to leave the country without the permission of the concerned trial court. Pursuant to the said condition, the applicant had deposited his passport before the learned trial court.

2. In view of the submission of learned advocate for the applicant as regards the applicant being desirous of travelling abroad, his passport no. T-2825419 is ordered to be returned to him by modifying condition no. 9(f). The applicant is permitted to have the interim custody of his passport for one year from the date of this order from the learned trial court where the same has been deposited, subject to his depositing a security deposit of Rs.5 lakhs with the trial court. Upon redepositing his passport, the trial court shall return the amount of security deposit without any further order from this court. It is clarified that, the applicant would invariably inform the trial court as regards his travel itinerary consisting of all the details viz. his mobile numbers, places of residences, visas and tickets including when he would leave the country and return, on every occasion.

3. In the facts of the application, the same is hereby partly allowed. Direct service is permitted.
