1. RULE. Learned A.P.P. waives service of Rule for the respondent – State.

2. By way of preferring the present petition, the petitioner has sought to challenge the judgment and order of conviction and sentence passed by the learned trial Court for the offence punishable under Section 138 of the Negotiable Instruments Act, which has been confirmed by the learned first appellate court. On the basis of the concurrent findings, it transpires that the petitioner was arrested on the date of the order passed by the learned trial Court and since then he is in judicial custody.
