ORAL ORDER

1. The present Special Civil Application is filed praying to direct the respondent-passport authority to consider the passport renewal application being File No.25-0055054434 of the son of the applicant namely Patel Sureshkumar Sankalchand.

Learned counsel for the petitioner submits that the applicant was born on 10^th May 1967 and in the school leaving certificate his name is mentioned as Patel Sureshkumar Sankalchand because, the original father of the applicant was Sankalchand Patel and his mother name was Arkhiben Sankalchand. It is submitted that as the real brother of the father of the applicant namely Patel Kashiram Mathurdas had no child and therefore, he had decided to adopt the applicant as their son and therefore, by way of adoption deed, the applicant was adopted by Patel Kashiram Mathurdas and that adoption deed was registered with the office of the Sub Registrar, Vijapur vide Sr. No.1082 on 14.07.1993. It is submitted that the applicant is coming from small village and had no knowledge about rules and regulations of the passport thus, in the year 2003, when the applicant got issued his passport for the validity of 10 years bearing passport No.E7028066 and in that passport, the name of the applicant was mentioned as "Patel Sureshkumar Sankalchand" means name of biological father was mentioned behind his name. It is submitted that on the basis of such adoption deed and now the applicant is knowing with his adoptive father i.e., Sureshkumar Kashiram Patel, he published public notice in the daily news paper informing public at large that now he will be known as Patel Sureshkumar Kashiram instead of Patel Sureshkumar Sankalchand. It is submitted that not only that the applicant, due to adoption, changed his name with adoptive father i.e., Patel Sureshkumar Kashiram in the Aadhar card, Ration card, election card, PAN card, as well as in the bank account operated with the Bank of Baroda. It is submitted that all such government issued documents and giving identity to the applicant shows the name of applicant as Patel Sureshkumar Kashiram means with the name of his adoptive father with him. Thereafter, in the year 2022, his biological father namely Sankalchand means Sankabhai was passed away. It is submitted that as the applicant was intended to renew his passport whose validity was expired in the year 2013 and as he has undergone the adoption procedure, the applicant has executed one affidavit on 02.07.2025 declaring that now he is known as "Patel Sureshkumar Kashiram" instead of "Patel Sureshkumar Sankalchand". It is submitted that the validity of his passport expired on 10.10.2013 but now the applicant intends to renew his passport, he made application through online portal of passport authority with all the relevant documents and paying prescribed fee wherein he was given appointment on 03.07.2025 vide File No. 25- 0055054434, but while appearing before the passport authority, they raised query about adoption procedure and later on given appointment on

11.07.2025 on that date also they raised query and made endorsement to keep the case on hold and thereafter also, the appointment was booked for the applicant by the passport authority on 19.07.2025 and on that date also, the authority made endorsement to hold the file only because of the adoption case.
