1. The applicant - accused and the Respondent No. 2 - original complainant are present before the Lok Adalat. With the consent of both the parties, this matter was taken up for hearing in Lok Adalat.

2. Mr. Milind Chabu Jagtap - respondent No. 2 (Orig. Complainant), who is today present before this Court, has tendered an affidavit of settlement wherein he has stated that he has no objection if the impugned order and judgment passed by learned 13^th Additional Chief Judicial Magistrate, Surat, in Criminal Case No.32793 of 2019 dated 14.05.2024 and order passed by the learned 2^nd Additional Sessions Judge, District and Sessions Court, surat in Criminal appeal No.539 of 2024 dated 11.11.2025 are quashed and set aside. Mr. Jarjeeskhan, the learned advocate appearing for the applicant – accused submits that, as per the settlement arrived at between the parties, the original complainant has received the amount due to him.

3. In view of the settlement arrived at between the parties and in view of the fact that now the original complainant does not want to continue with the proceedings, the impugned order and judgment passed by learned 13^th Additional Chief Judicial Magistrate, Surat, in Criminal Case No.32793 of 2019 dated 14.05.2024 and order passed by the learned 2^nd Additional Sessions Judge, District and Sessions Court, Surat, in Criminal Appeal No.539 of 2024 dated 11.11.2025 are hereby quashed and set aside.

5. In view of the aforesaid settlement between the parties, present application is allowed. In view of disposal of main application, all connected applications also stand disposed of.

6. It is also required to be noted that this order will not be treated as precedent in any future cases for reference.
