ORAL ORDER

Present application is preferred by the Petitioners under Section 482 of the Code of Criminal Procedure, seeking quashing of FIR No.11191015250406 of 2025 registered with Nikol Police Station, Ahmedabad City for the offences punishable under Sections 118(1), 115(2), 125(a), 296(b), 324(4) and 54 of the Bharatiya Nyaya Sanhita, 2023.

Heard learned Advocate for the Applicant and learned APP for the Respondent – State.

Rule. Learned APP waives service of notice for and on behalf of the respondent – State.

Learned Advocate for the Petitioners has submitted that the matter has been amicably settled between the parties and they are now not willing to proceed with the complaint any further.

Leaned Advocate Mr. Satyajit Songara appearing on behalf of Respondent No. 2 (Original Complainant), who is present before this Court, has placed on record duly sworn in Affidavit dated 16.12.2025. The same is ordered to be taken on record. Learned Advocate has submitted that matter has been amicably settled between the parties and there is no objection if present application is allowed. The affidavit reads thus:
“I, Gorakhprasad Bachhalala Prasad, Aged:45 Year, Religion: Hindu, Resident of 3979, Govindbhai Ni Chali, Lilanagar, Nikol, Ahmedabad City do hereby state on solemn affirmation of oath as under:
1. That, I am the complainant of FIR being C.R. No.
11191015250406 of 2025 registered with Nikol Police Station, Ahmedabad City under Sections 118(1), 115(2), 125(a), 296(b), 324(4), 54 of the Bharatiya Nyay Sanhita, 2023 (hereinafter referred to as "BNS").
2. I say and submit that dispute between deponent and applicant i.e., has been resolved. It is (1) Akash Goud, (2) Avinash Goud submitted that the deponent has no objection if FIR being C.R. No. 11191015250406 of 2025 registered with Nikol Police Station, Ahmedabad City under Sections 118(1), 115(2), 125(a), 296(b), 324(4), 54 of the Bharatiya Nyay Sanhita, 2023 is quashed and set aside against present applicant i.e., (1) Akash Goud, (2) Avinash Goud.
3. I say and submit that in view of the settlement arrived at between the deponent and present applicant i.e., (1) Akash Goud, (2) Avinash Goud, it is submitted that I have no objection if the FIR being C.R. No.
11191015250406 of 2025 registered with Nikol Police Station, Ahmedabad City under Sections 118(1), 115(2), 125(a), 296(b), 324(4), 54 of the Bharatiya Nyay Sanhita, 2023 is quashed and set aside against present applicant i.e., (1) Akash Goud, (2) Avinash Goud.
4. I say and submit that present affidavit is filed without any threat and coercion.
Whatever is stated hereinabove is true to the best of my knowledge and belief and I believe the same to be true.”
6. Considering averments made in the Affidavit as also the submissions made by the learned Advocates for the respective parties, the present Application deserves to be allowed and is hereby allowed. The FIR No.11191015250406 of 2025 registered with Nikol Police Station, Ahmedabad City is hereby quashed and set aside. Rule is made absolute.
