ORAL ORDER
1. Perused the Speaking to Minutes note. In the order dated 04.12.2025 passed in the captioned application, paragraph no. 1 has been wrongly transcribed and added as part of the order. Paragraph no. 1 is accordingly deleted and the corrected order shall read as under:
“
1. Rule. Learned APP waives service of notice of rule for respondent – State of Gujarat.
2. By way of the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”), the applicant has prayed for anticipatory bail in the event of arrest in connection with the FIR being C.R. No. I- 11201001250001 of 2025 registered with CID Crime Gandhinagar Police Station, Gandhinagar for the alleged offences as mentioned in the FIR.
3. Heard learned Senior advocate Mr. N.D. Nanavati assisted by learned advocate Mr. N.L. Thaker for the applicant, who has submitted that the offence pertains to documentary evidence for which, the custodial interrogation of the applicant is not required. The applicant is ready to cooperate and abide by all the conditions imposed by the Court while enlarging her on anticipatory bail, and will not take disadvantage of her liberty. Learned Senior advocate has further submitted that, the husband of the applicant who is co-accused has already mortgaged the property against the loan transactions and the value of the mortgaged property is higher than the loan amount and he is making all possible efforts to repay and settle the loan amount of the complainant bank. The entire dispute is of civil nature pertaining to recovery of loan amount, hence the applicant may be enlarged on anticipatory bail subject to the necessary conditions.

It is pertinent to observe that, learned Senior Advocate Mr. Nanavati on 01.12.2025 while arguing this matter had submitted that, without prejudice to the applicant’s defence and without admitting the averments of the I.O. about there being outstanding dues of Rs. 10,00,00,000/- to be recovered only from the applicant, the applicant was ready to deposit the said amount of Rs. 10,00,00,000/ with the complainant bank. Accordingly, this Court had granted time to the applicant to show her bonafides.
5. Learned Senior advocate Mr. Nanavati has filed an undertaking which reads as under:
“I, Aman Bijal Mehta, aged adult, Female and Bijal Jayesh Mehta, Aged-52 Years, Male, having an address at A- 5/9, Godavarinagar Vibhag-2, Near Civic Center, Vasna, Ahmedabad, Paldi, Gujarat – 380007 and presently in judicial custody since January 2025, do hereby state, undertake and declare on solemn affirmation and state as under;
1. That the above captioned application, being Criminal Miscellaneous Application No.8279 of 2025, has been preferred before this Hon’ble court seeking anticipatory Bail of Aman Bijal Mehta in connection with the FIR being F.I.R. No. 11201001250001/2025 dated 02.01.2025 registered with CID Crime Gandhinagar Zone, Police Station, Gandhinagar City.
2. That, considering the allegation leveled against and what has been indicated before the Court during the course of hearing of the captioned application, that co-accused Manoj Nagarju Chaudhary (of Vrundavan Township) has invested an amount of Rs. 9,75,00,000/- and another co-accused Nandini Roadlines has invested an amount of Rs. 45,00,000/- out of loan obtained from the complainant bank and therefore, we are ready and willing to depo
