IA ORDER

1. RULE returnable forthwith. Ld. APP waives service of

Rule on behalf of the Respondent State.

2. Present application is filed by the applicant for

modification of conditions imposed vide order dated

19.06.2019 passed in Criminal Misc. Application No. 8882

of 2019 by this Court.

3. Learned advocate for the applicant has submitted that

while enlarging the applicant on bail, this Court vide order

dated 19.06.2019 passed in Criminal Misc. Application

No.8882 of 2019 has imposed condition nos.(c) and (d) i.e.

“the applicant shall surrender passport, if any, to the lower

Court within a week” and “the applicant shall not leave the

State of Gujarat without prior permission of the Sessions

Judge concerned, respectively”. It is further submitted that

the applicant is practicing chartered accountant and is

having client outside India and is therefore required to

travel outside India frequently. It is further submitted that

the applicant is obeying all the conditions imposed upon

him vide aforesaid order regularly. He has, therefore,

submitted that the aforesaid conditions be kept in abeyance

for a suitable period.

4. Learned Additional Public Prosecutor has submitted

that the applicant has not placed on record the immediate

travel plan and therefore, no reason has occasion for this

Court to keep the aforesaid condition in abeyance and thus,

has prayed to dismiss the present application.

5. Heard learned advocate Mr. Premal S. Rachh for the

applicant, learned APP for the Respondent State as well as

perused the documentary evidences produced on record.

6. Having regard to the cause shown in the application,

the conditions in question are ordered to be kept in

abeyance for a period of six months subject to deposit of

amount of Rs. 2 lacs before the concerned Trial Court

towards security deposit which shall be refunded to the

applicant upon expiry of the aforesaid period. The applicant

shall furnish detailed travel itinerary before the trial Court

before traveling abroad during the aforesaid Period. Other

conditions of the order dated 19.06.2019 shall remain

intact.
