ORAL ORDER

(PER : HONOURABLE MR. JUSTICE BHARGAV D. KARIA)

1. Learned advocate Mrs.Vibhuti P. Panchal appearing for the applicants.

2. The present application is preferred under Section 12 of the Contempt of Courts Act, 1971 with a prayer to hold and declare the opponents guilty of willful disobedience of the Order dated 09.10.2018 passed in Special Civil Application No.15653 of 2018 under the provisions of the Contempt of Courts Act. The Order dated 09.10.2018 passed by the learned Single Judge reads as under:

the facts of the case are similar to Special Civil Application No.19872 of 2017 and the petitioners of the said petition as well as the present petition are similarly situated.

2.In the aforesaid view, Rule.

3.Respondents are directed to maintain status-quo with regard to the service of the petitioners during pendency of the petition.

To be listed with Special Civil Application No.19872 of 2017.

Direct service is permitted.”

3. It is stated in the application that the respondents have not paid the salary to the applicants and thereby there is breach of the Order dated 09.10.2018, whereby the respondents were directed to maintain status quo with regard to the service of the petitioners during the pendency of the petition.

4. Upon query raised by the Court, learned advocate for the applicant submitted that the main petition is pending before the learned Single Judge.

5. It is also averred in the application that a notice was issued on behalf of the applicants to pay the salary of Rs.10,000/- per month from October 2025 till date. However, by reply dated 26.12.2025, the respondents informed the applicants that clarification has been sought from the State Government and that the salaries shall be paid as and when the grant is received.

6. Be that as it may, as the main matter is pending, the applicants can raise their grievance in the said petition. The present application is, therefore, not entertained and is disposed of with liberty to file an appropriate application in the pending petition for redressal of the grievance raised in this application.
