IN THE HIGH COURT OF GUJARAT AT AHMEDABAD
Vaibhavi D. Nanavati, J
NARENDRABHAI CHAMANLAL PUJARAV/sTHE JOINT CHARITY COMMISSIONER RAJKOT (INCHARGE)
R/SPECIAL CIVIL APPLICATION NO. 13363 of 2023 | C/SCA/13363/2023

Advocates:
For the Appellants/Petitioners: Mehul Shah, Jenil M. Shah
For the Respondents: Ayaan Patel

The court stayed restrictions on renting trust properties for functions, emphasizing that trust administration must align with the Trust Deed and the statutory requirements of Section 36 of the Gujarat Public Trust Act, 1950.

Headnote:The petitioners, trustees of a public trust registered under the Gujarat Public Trust Act, 1950, challenged an order dated 25.4.2023 passed by the Incharge Joint Charity Commissioner, Rajkot, in an application filed under Section 41A of the Act. The impugned order restricted the trust from renting out its immovable properties for functions, which serves as a primary source of income for the trust's educational objectives, and mandated permission under Section 36 and rental via auction. The primary issue is whether the restrictions imposed by the respondent authority are contrary to the Trust Deed and the provisions of Section 36 of the Act. The court observed that the submissions regarding the contradiction between the impugned order and the Trust Deed and resolutions require consideration. The court issued a rule, stayed Condition No. 3 of the impugned order, and directed the parties to act in accordance with the Trust Deed and specific resolutions, while ensuring no property is transferred in violation of Section 36 of the Trust Act.
