R/CRIMINAL MISC.APPLICATION (FOR QUASHING & SET ASIDE FIR/ORDER) NO. 5064 of 2026
For the Appellants/Petitioners: Jeet D. Patel, V R Lodha
For the Respondents: Krina Calla, R.K. Trivedi
Criminal proceedings in matrimonial disputes can be quashed by the High Court if the parties have reached an amicable settlement, as continuing such proceedings would be a futile exercise and an abuse of the process of law.
Headnote:The applicants sought the quashing of a First Information Report registered for offences punishable under Sections 54, 85, and 115(2) of the Bharatiya Nyaya Sanhita, 2023, and Sections 3 and 4 of the Dowry Prohibition Act, invoking the inherent powers of the Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The complainant filed an affidavit stating that the dispute had been amicably resolved through the intervention of family and community members, and expressed no objection to the quashing of the proceedings. The Court examined whether continuing the criminal proceedings would constitute an abuse of the process of law. Relying on established precedents, the Court reasoned that since the parties had reached a settlement and the complainant no longer wished to proceed, continuing the trial would be a "futile exercise" and would result in "unnecessary harassment" to the applicants. In the result, the application is allowed.
