R/CR.MA/3684/2026 | R/CRIMINAL MISC.APPLICATION (FOR SUCCESSIVE REGULAR BAIL - AFTER CHARGESHEET) NO. 3684 of 2026
For the Appellants/Petitioners: Krutarth K Desai
For the Respondents: Meet Thakkar
Regular bail may be granted after the charge sheet is filed if the accused has been in prolonged custody and the trial has progressed, provided there is no significant risk of fleeing or tampering with evidence.
Headnote:The applicant sought regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with an FIR involving the abduction of a victim who subsequently committed suicide. The court noted that the investigation is complete, the charge sheet has been filed, and the applicant has been in custody since August 11, 2024. The primary issue was whether the applicant was entitled to bail given the gravity of the offense. The court reasoned that since the trial has progressed to the stage of production of muddamaal and considering the factors of prima facie case, availability of the accused, and the risk of tampering with witnesses, the application deserved consideration. Rule is made absolute.
