ORAL ORDER

UPON hearing Advocate Mr. Salil M. Thakore for the Plaintiff;

AND UPON reading the Plaint, the Affidavit in support of the Order of Arrest, the Undertaking and other documents filed herein;

AND UPON the Plaintiff's submission that the Defendant Vessel "MV Elvita R - IMO: 9395264" is presently anchored at Bedi Bunder Port, Jamnagar, Gujarat, within the admiralty jurisdiction of this Court.

AND UPON the Plaintiff's submission that it has a maritime claim against the Defendant Vessel for a total sum of USD 1,07,639.87 (United States Dollars One Hundred and Seven Thousand Six Hundred and Thirty Nine and Eighty Seven Cents Only) comprising of a principal amount of USD 98,560.00 (United States Dollars Ninety-Eight Thousand Five Hundred and Sixty Only) and interest till 31.12.2025 and further interest thereon and legal costs, in relation to the supply of engine items, paint items, oil items, etc. to the Defendant Vessel;

AND UPON the Court being satisfied that the claim falls within the definition of "maritime claim" under Section 4(1)(l) and (m) of the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017 and that the Plaintiff has established a prima facie claim in respect of the Defendant Vessel;

AND UPON taking note of the Undertaking given by the Plaintiff to pay such damages as this Court may award in the event of the Defendant Vessel sustaining prejudice pursuant to the order passed by this Court;

IT IS HEREBY ORDERED that:

a) The Defendant Vessel "MV Elvita R - IMO:

9395264" together with her hull, engines, gears, tackles, bunkers, machinery, apparel, plant, furniture, fixtures, appurtenances and paraphernalia, plant and machinery at present at the anchorage at Bedi Bunder Port, Jamnagar or wherever she may be within Indian territorial waters, be arrested by a Warrant of Arrest of this Court;

b) The Master, Owner, and all persons interested in the Defendant Vessel be restrained from removing the Defendant Vessel from the jurisdiction of this Court without the prior permission of this Court;

c) The Defendant Vessel be at liberty to apply for vacation of the arrest upon furnishing adequate security for the claim amount in the sum of USD 1,07,639.87 (equivalent to INR Rs. 97,10,709/-) to the satisfaction of the Registrar of this Court;

d) The order of arrest shall remain in force until further orders of this Court.

e) Registry to issue Warrant of Arrest accordingly, today.

IT IS FURTHER ORDERED that this Order of Arrest be communicated forthwith by the Registry of this Court by email, today, to the following authorities for implementation and compliance:
