1. Heard learned advocate Mr. M.B.Gohil for the applicant, learned advocate Mr. Mukesh Rathod for respondent No.1 and learned Assistant Government Pleader Ms. Vaishnavi Verma for respondent No.2.
2. Rule returnable forthwith. Learned advocate Mr. Rathod waives service of notice of rule on behalf of respondent No.1 and learned AGP Ms. Verma waives service of notice of rule on behalf of respondent No.2.
3. By these applications under section 5 of the Limitation Act, 1963, the applicant seeks condonation of delay of 411 days caused in filing the captioned Letters Patent Appeals.
4. Having regard to the submissions advanced by the learned advocate for the applicant and more particularly, considering the averments made in the memorandum of applications, the Court is of the view that the delay caused in filing the Letters Patent Appeals has been sufficiently explained.
5. The applications, therefore, succeed and are, accordingly, allowed. The delay caused in filing the Letters Patent Appeals is hereby condoned.
6. Rule is made absolute accordingly with no order as to costs.
7. Registry to give final registration number to Letters Patent Appeals forthwith and list the matters today.
