ORAL ORDER

1. Rule returnable forthwith. Learned APP waives service of rule on behalf of the respondent State.

2. The present application is filed by the applicant seeking temporary bail for a period of 7 days on the ground of marriage ceremony of his two sisters which is scheduled on 13.02.2026.

3. The applicant had preferred an application seeking temporary bail for a period of 15 days before the Court of

6^th Additional Sessions Judge, Surendranagar by way of filing Criminal Misc. Application No. 75 of 2026. The competent court partly allowed the said application and directed release of the applicant on 13.02.2026 from 8 am to 5.30 pm, subject to conditions.

4. Learned advocate for the applicant submitted that, the applicant is the only brother and his presence is required for various marriage rituals. Having considered the ground mentioned in the application and considering the facts and circumstance of the case, this court is inclined to exercise discretion in favour of the applicant.

5. Accordingly, the order dated 06.02.2026 passed by the 6^th Additional Sessions Judge, Surendranagar in Criminal Misc. Application No. 75 of 2026 is modified as below:

(I) The applicant is directed to be released on temporary bail, without police jaapta, from

10.02.2026 to 14.02.2026 till 02.00 pm upon his furnishing a security deposit of Rs. 2,00,000/- (Rupees Two Lakhs only) before the concerned competent court, prior to his release. The said deposit shall be returned to the applicant when he surrenders within the stipulated time without any further order from this Court. In case, the applicant fails to surrender within stipulated time, the amount of security deposit shall be forfeited by the competent court.

(III) The applicant shall mark his presence before the concerned police station every day and shall surrender to the jail authorities on expiry of the temporary bail period i.e. on 14.02.2026 by 02.00 pm.

6. It is hereby clarified that, no further extension shall be granted on expiry of the temporary bail period.

7. The application is allowed in the aforesaid terms.

Rule is made absolute. Direct service is permitted today.
