CORAM:HONOURABLE MR. JUSTICE NIRZAR S. DESAI Date : 27/03/2026
ORAL ORDER
1. Heard learned advocate Mr. Rahul Sharma for the petitioner. He draws the attention of this Court to the order dated 30.09.2025, whereby this Court, after passing an elaborate order, permitted the petitioner to appear in the 5th semester of the LL.B. course with respondent No. 2–college. Learned advocate Mr. Sharma further submits that the petitioner is ready and willing to appear in the 4th semester examination of the LL.B. course in the same college and, for that purpose, he shall not claim any equity or right, and the same shall be subject to the final outcome of the present

petitioner was permitted to appear in the 5th semester examination. Therefore, if the petitioner is now permitted to appear in the 4th semester examination on the same grounds as recorded in the order dated 30.09.2025, the same would not adversely affect the respondents. Therefore, the respondents are directed to allow the petitioner to appear in the 4th semester examination of the LL.B. course in respondent No. 2–college. Learned advocate Mr. Sharma, upon instructions, makes a statement that if the petitioner is permitted to appear in the 4th semester examination of the LL.B. course in respondent No. 2–college, the same shall not create any equity or right in favour of the petitioner and shall be subject to the final
outcome of the present petition.
3. Learned advocate Mr. Meet Shah, though opposing the request made by learned advocate Mr. Sharma to allow the petitioner to appear in the 4th semester examination in the respondent University, could not dispute the fact that the earlier order dated 30.09.2025, allowing the petitioner to appear in the 5th semester of the LL.B. course, has already been implemented. Accordingly, such opposition is required to
be outrightly rejected.
4. In view of the above, the respondent University is directed

to permit the petitioner to fill up the form for the 4th semester and to appear in the 4th semester examination of the LL.B. course in respondent No. 2–college. The result of the petitioner shall be kept in a sealed cover and shall be declared
