ORAL ORDER
1. By this note for speaking to minutes, it has been pointed out that, while passing the order dated 09.02.2026, in the 1st and 5th paragraphs, late surrendered days are mentioned as ‘43’ instead of ‘30’. Also, in paragraph-2 of the said petition, ‘SCR.A No.10677 of 2024’ is mentioned instead of ‘SCR.A No.13209 of 2024.’
2. In view of the above, the corrected order dated
09.02.2026 would now read as under:
“1. The present application is filed by the Applicant for regularization of his Parole Leave as he had surrendered late by 30 days when he was released and which was extended till 02.09.2025.
2. Learned advocate for the applicant submitted that, the last order i.e. on 27.06.2025 which was passed by the Co-ordinate Bench in SCRA No. 13209 of 2024 with CRMA No. 02 of 2024 wherein, the interim relief was granted earlier was continued till further order. The applicant had understood that, his Parole Leave was continued and he had also taken advice from his local lawyer who told him that, his Parole Leave was continued and he need not surrender. Pursuant to the same, he had also submitted a representation to the concerned authorities on 29.09.2025.
3. Heard learned Advocate for the Applicant and learned APP for the Respondent – State.
4. Rule. Learned APP waives service of Rule on behalf of the Respondent State.
5. Having heard the arguments advanced by the learned advocate for the applicant and the learned APP, and considering the facts and circumstance of the case, this court is inclined to exercise discretion in favour of the applicant. Therefore, the prayer for regularization of period of late surrender by 43 days is hereby allowed, subject to the condition that, the applicant shall deposit Rs. 10,000/- towards cost to the Jail Authority, within fifteen days from today i.e.
24.03.2026.
6. Application stands allowed. Rule is made absolute.
Direct service is permitted.”
