IA ORDER
1. The present application is filed by the Applicant for enlarging him on Parole leave for a period of 30 days on the ground mentioned in the application.
2. Rule returnable forthwith. Learned APP waives service of Rule on behalf of the Respondent State.
3. Heard learned advocate Mr. Amit D. Shah for the applicant, who has submitted the extension of temporary bail as the applicant’s wife is presently in ICU in Saheb Orthopaedic Hospital. Mr. shah has further drawn the attention of this Court towards the medical certificate submitted by him from where it is reflected that the wife’s surgery for removal of Right Ovarian Cyst is scheduled on 25.02.2026 and the doctor has opined that she would require 3 to 4 days of hospitalization post surgery. Hence, Mr. Shah has urged this court to allow this application.

Heard learned APP Ms. Jirga Jhaveri, who has submitted that the Police Inspector of Salabatpura Police Station, Surat City has affirmed the fact about the applicant’s wife having been hospitalized and presently under treatment in the ICU and her surgery having been scheduled on 25.02.2026. Accordingly, Ms. Jirga Jhaveri has urged the Court to pass necessary order.
5. Having considered the ground mentioned in the Application and having heard the learned advocates for the respective parties as also considering the facts and circumstance of the case, this Court is inclined to exercise discretion in favour of the applicant.
4. Considering the aforesaid facts, the present application is partly allowed. The Applicant is ordered to be released on Temporary Bail for a period of 14 days from the date of actual release, upon furnishing a personal bond of Rs.15,000/- (Rupees Fifteen Thousand only) with a surety of the like amount to the satisfaction of the jail authority and on a condition that the applicant shall mark his presence before the concerned police station on every alternate day and on a further condition that the Applicant shall surrender to the Jail authorities on expiry of the Parole period. He shall submit the medical case papers of his wife’s surgery which she would undergone during this period of temporary bail.
5. This Court shall not entertain application for reduction of amount of personal bond and surety.
6. The application is allowed in the aforesaid terms. It is hereby clarified that no further extension shall be granted. Rule is made absolute.
